Jim,
This petition isn't addressed to PETA, it is to Disney. No amount of arguing will sway the minds of fanatics. That is not what this is about. This is about letting Disney know that the real constituant, the real source of money, doesn't want to play games with these lifestyle nazi's. I really hope you'll rethink your decision to not join your fellow FM'ers in having Disney hear their voice. Big company's like this listen to who speaks up the loudest. To this point, it has been the other side. Prepare to hear the good guys roar.

Jim W makes a good point. It appears that the organization in question did not obtain permission to use the characters, but instead appropriated them for publicity – something the subsequent petition is helping them with. According to BASS/ESPN Outdoors (a Disney subsidiary) communications director George McNeilly: "The Walt Disney Co. DID NOT grant permission to PETA to use the Finding Nemo characters" (emphasis added). If you read the group’s HSOforum, the wording is extremely vague and they never actually claim that Disney gave them the rights or any permission, something you’d think they’d do loudly if it were really the case. The group has a history of using corporate logos such as Burger King and KFC without permission to attract attention.

Second, if you’ve seen the film the “Fish are friends, not food line” is presented as pure sarcasm perhaps even poking fun at the group. For instance, one shark says, “Fish are friends not food, except dolphins.” J

Finally, there is this:

Spike, before I embarass myself any further, can you refrence the comments from Disney for validity and accuracy? Perhaps a link to said comments.

It seems to me Disney could sue PETA's tushy off for appropriation of it's intellectual property. Some of these images are lifted right off of the screen.....

irvingdog,

The quote appears on Bassfan dot com in the "dock talk" archives for October 2003. I found corraboration of the Disney statement by Bass Federation offical Don Corkran:

"During a teleconference with the Divisional Representatives today, the question of Disney and PETA was raised - we now have the answer. Please read the below statement from Disney:

“There is no truth to this story. The Walt Disney Company did not grant permission to PETA to use the Finding Nemo characters.""

Yes, it's possible that Disney could sue, but copyright and "fair use" is complicated law -- perhaps, since this is not commercial use, there isn't much of a case or Disney doesn't want to provide more publicity for them.

P.S. Nothing to be embarrassed about. Being vigilant about these groups is important, but we need to be cautious at the same time.
