He was accused of brandishing a gun. All that means is it was visible during the scuffle or whatever happened. Virginia is a totally different situation as well as any citizen can formally charge another and the police don't have to be involved initially with the charge. Not making any excuses but the law is in place to carry with a permit and accordingly you are held to a higher level of responsibility when you are carrying. Common sense says walk away.
