Intent to sue


Wish-I-Were-Fishn

Question

My son's GF changed jobs and her old employer sent her an "intent to sue notice" pursuant to her non-compete agreement she had signed with them. The case wouldn't hold up in court, but the whole thing is driving her nuts.

I think the letter was intended to scare her into leaving her new job. Is there a time limit once she received the letter till they need to act upon it? Like sh_t, or get off the pot so to speak?

I had a similar situation once and I contacted the department of labor in my home state. They reviewed the documents and contacted the previous employer. In my case the state said it was an attempt to bully me. They state took it from there. Once the state contacted the employer, they whole thing quickly went away. This may be an avenue you would also wish to look into. I also think it wise to gain whatever legal advice from the state offered. If they recommend you need to engage a lawyer, do so.

Imagine how many people have thought this only to find themselves on the back end of a judgment. The only person that can know this for sure is the judge at the time of the hearing.

The Hennepin County Bar Association has an attorney referral service. If you contact them they give you contact info to lawyers specializing in the area and I think you get a free consult for an hour. Never had to use it but I would make contact with them.
