They do not have the right to confiscate the phone. They can ask him to leave, that's the extent of it.

Over 10 years ago I was in the retail business, and what they are trying to prevent is a competitor going through and tracking their prices, but it happens anyway.

Confiscating the phone is one of the craziest things I've ever heard of.

Competition, there are a lot of retail merchants out there that send their employees to the competitors store to record the prices on similar products they both offer. Doesn't excuse the employee from threatening your friend, but I'm sure that's the reason.

I don't know if they can confiscate the phone unless there is a notice at the store entrance regarding it. Cub foods and other stores have those notices up front. Usually have to specifically look for them to notice them though.

If somebody, anybody tried to grab something of mine out of my hands.... oh oh..... they just made a horrible mistake. If the person wouldn't listen to me tell them that I was talking to a friend and continued on with some ridiculous misguided policy .... I'd talk to the manager and let him/her and everybody else know they didn't have me as a customer any longer and I'd pass along the good word.

Funny, I was in Sportsman's Warehouse (Fargo) yesterday over lunch and saw something that is pretty relevant to this story. My brother and I noticed a Scheels employee in an isle writing down the price of some items. I wouldn't doubt if the interaction was a direct result of the Scheels guy being seen getting information the same day. Maybe just wrong place, wrong time for your buddy.

But I agree, posted on a sign or not, if an employee of a store tried to take my phone away from me, it might get pretty ugly pretty fast. At the very least it would be the last time I ever did business there.
