If law only followed common sense think of how much better things would be!!

I believe the law considers driving on ice the vehicles operators sole responsibility. Therefore dealt with on their auto policy.

Most auto policies will NOT cover driving on ice, so if your not covered for it with a rider and you go down, you be screwed. (I checked)

If a resort maintains a plowed trail off there private paid landing, and it runs off into bad ice that is not marked as a hazard, well there may just be a issue for insurance Co. and the courts?

Odds are very good that you as the vehicle operator will get screwed in the end, as it was your choice to drive on the ice.

Here is my point of veiw, if I go out on the ice and fall through then that's life.
How many times have we all been told the ice is never safe?
Now as for the resorts charging to pass, well that's ok with me.But as was stated earlier, if I make it all the way accross the big pond to fish.I didn't use any private road to access, and the water is not owned by the resorts then I sould be free to fish any part of that lake I so desire.
I do understand that the resorts spend money on gas,maintnance, and insurance for their vehicles and they need to recup this some how.But if one comes up to me and tries to kick me off his road with out first being nice about it, boy they better hope there is glare ice and they have cleats on.I will gladly pay a nominal fee to access a road if asked nicely,even if I didn't use their access.Rest asured I will leave by their road though.
I have been yelled at in the past, I just told the one-who-thinks-I-am-silly to follow me if he can.Took off across the lake never to see him again.Coarse I did have an 8 inch lift,big block v8,and big tires as opposed to his little Toyoda with the barrels tied on it smile.gif

Read my post again! It said you would have to relate negligence to the act of charging a fee to access the lake. This has nothing to do with insurance. If an attorney finds a way to show the resort was negligent (IE not informing the paying customer that the ice was thin), they could be negligent! Scott Steil

i would think where you chance liability is if you are chaging to drive on (your) roads on the lake... if you are paying to gain access across someone property well then liability would end at the edge of your property BUT if you are charging to use a road you plowed on the lake then some hot shot lawyer would pin that as your liability also i would think.the key here would be to charge to access the lake from your property not to charge people to be on your road. and isnt the lake property of the state?if so then wouldnt the plowed road also become the property of the state?i can see charging someone to cross your property to gain access to the lake but you should include the fees of plowing into that fee and the roads on the ice should be for anyone who should happen to come across them.
