No problem. I just don't like it when some jump to conclusions without knowing the facts or the circumstances. The police officier may have waited 15 minutes after the accident before giving the test and it would then have been pretty accurate. It usually takes about that long for the alcohol to clear the mouth.

you also have to remember though, you blow on the street, then approx, 2 hrs after the fact you may recieve another. That's why some people's charges look like this:

Disposition (Judicial Officer: Judge, Presiding)

1. .13 DUI 4TH DEG

Dismissed

Disposition (Judicial Officer: Judge, Presiding)

2. DUI .08%> W/IN 2 HRS .13

Guilty

But you are not ever going to blow .32 and then an hour later .04..it just doesn't work that way.

I realize that in Mn the first is just a pre-arrest test, the latter is the official one. I don't know how they do it where Annette was stopped, if he was even taken to jail-not enough info. to say if he has a drinking problem or not. It will be up to Wallace and NASCAR to decide if he can drive or not and if there will be any type of sanctions against him.

"I am deeply remorseful for my actions and my extreme lack of judgment," Annett said in a statement. "I let down my team, my sponsors, my fans and my family; I sincerely apologize to everyone that I hurt. This was truly a life-changing moment for me. Despite all of the negativity that will undoubtedly arise from it, I'm going to strive to use this incident as the impetus to make a lot of positive changes in my life."

According to WCNC, charges against Annett also included failure to reduce speed, texting while driving, and resisting a public officer. A team spokesman said Annett was still scheduled to drive the No. 62 car in next week's Nationwide season opener at Daytona International Speedway, although he will face some internal sanctions at the least.

"Rusty Wallace Racing does not condone, nor tolerate, substance abuse by any of its employees," Wallace said. "In line with this, RWR is currently working with Michael to develop a package of sanctions which will address this issue. Among these will be successful completion of a comprehensive alcohol awareness program, a zero tolerance policy toward alcohol use, a year-long community service program and additional internal sanctions."

NASCAR is also looking into the incident, according to a spokesman. "NASCAR is in contact with Michael Annett's owners at Rusty Wallace Racing to determine the facts and what happened," he said in a statement. "NASCAR will address the issue accordingly once we have a clear understanding of all the facts."

It had to have been at least 15 minutes after his last drink by the time they administered the first test, according to this article...unless he was drinking in the car.

It sounds like he is supported by his team, but he needs help. If RWR sees potential in him, and wants to keep him as a driver, they can find a sub while he spends time in rehab. Parking him for a race isn't the same as firing him, but it may help get the message through that this isn't tolerated.
