Tire blow out question

My wife's Explorer had a tire blowout going down the highway @70mph (son driving). Complete blowout from sidewall to sidewall-passanger rear tire. Didn't hit anything or pothole. The tires are BFG Long Trail T/A Tour. 11,000 miles, 9/32 tread left. The dealer told me they couldn't tell if defective tire or not, but plugged some mileage numbers, tire depth into the computer to come up with an adjustment amount. Paid $170.00 per tire, they offered to replace it for $71.00. I feel the tire failed and should have been replaced for free, what do you think? Thanks....

2006, replacement tires. The receipt has noted that the tires are different from oem and "it may change the handling or stability characteristics". "further info is available from salesperson".

If anything they should have just charged you for the mount and balance not for the tire when it sounds like a manufacturers defect. Or slapped a new one on there and not charged you anything, just my 2 cents. The whole "it may change the handling or stability characteristics". "further info is available from salesperson" sounds kinda fishy to me.

Unless you purchased a road hazard protection I think you are going to have a tough time getting them to replace it because of a "defect." also sounds like you missed a tire rotation, which they also look at for any type of warranty (they start off with 12/32" of tread. The rear tires are the wear tires and you where already down to 9/32").
