Benfishin Posted May 22, 2006 Share Posted May 22, 2006 I've got a buddy who was tagged w/ careless driving(he got his DUI reduced). Does this show up on his record as a felony in Canada? oldcritter Posted May 23, 2006 Share Posted May 23, 2006 Problem is the "careless" may be coupled with an "implied consent" violation that appears on the driving record. Taken together means a drinking/driving violation occurred, and can, in some situations, be used for enhancing subsequent drinking violations from a misdemeanor to a gross misdemeanor. SCONASOTAN Posted May 24, 2006 Share Posted May 24, 2006 I have the same situation and I was told when I called St. Francis that if my DUI was dropped, that I was ok. (3 years ago) No matter how you look at it (dropped /reduced) the CRIMINAL offense is careless driving and as far as I know that is ok in Canada. I have been through the border at least 2-3 times per year since then with no trouble. However, I have never been pulled over and searched either. The imlied consent falls under another category I believe some sort of CIVIL offense. YOu were not convicted of DUI and that cannot be seen as the same as a conviction. That would be like saying we don't allow sex offenders in Canada and then not allowing Kirby Puckett (god rest his soul) in because he was seen on TV being accused of touching boobs.Hope this helps.
