Electric oven connection question

I am going to install an electric double wall oven today and I have an electrical question. The installation instructions say the ground and neutral come from the factory bonded together. They say to do either a three wire or four wire connection, whichever is required by code. I can do either with what is coming into my J-box. If it matters, it’s a 40A circuit. Which way is correct for code? Thanks!!

It might depend...

For new construction it's 4 wire. However, if you're simply replacing an old appliance then an existing 3-wire install might be grandfathered.
