You can touch up over the rust, but be prepared to re-touch it every six months or so. The only good long-term solution is to completely clean up the rusted metal before you paint. If the spot is small enough, you can do this with a couple of pieces of 80 grit sandpaper. If the spot is larger and/or has pits in it, then your local auto body supplier can hook you up with some cool little abrasives that fit right in your drill. The best way to keep the repair from getting any larger than necessary is to put masking or duct tape on the paint all the way around the spot your sanding. That way you don't get scratches all over. Sand the metal untill it's clean and then (this next step is very important if you wan't this to not rust out again) brush on some good metal primer before you brush on your color. There are no rust preventing properties in the touch up paint so eventually moisture will penetrate it and attack the metal again if you don't use the primer. Again, your local body supplier can recommend you with the right stuff.
