I think they ENCOURAGE the use of non toxic shot, but I can't seem to find a clear answer.

I have searched all through here:

Page 40 seems to have the most info on non-toxic shot. I honestly just shoot steel all the time now, as I hunt a lot of public and it is just easier to not have to worry.

And there are a few more specifics on right-of-way hunting on page 35 of rundrave's link.

I seem to remember something in the rules about lead shot being legal, UNLESS the right of way is adjacent to land that would otherwise require non-toxic shot. So you need to know where you are, and the status of the property next to the right of way.

I'm with rundrave in that I use nothing but steel shot all the time now. In fact, I stay legal for waterfowl even when out pheasant hunting. Seems like we are always able to pick up a duck or two when out pheasant hunting...especially this year.
